KidzBrands, Inc. (“KidzBrands”) respects your concerns about privacy.  This privacy policy (“PRIVACY POLICY”) applies to the website (“Website”) and mobile applications (“Apps”) operated by KidzBrands, subsidiaries and affiliates (“AFFILIATES”), including Little Pouch, Pouch Kids, Pouch Qubits, and to any other site or service that is operated by KidzBrands and links to it (“SERVICES”).  This PRIVACY POLICY uses the terms “we” “our” and “us” to refer to KidzBrands and “you” or “user(s)” to refer to individuals described by the information (“PERSONAL INFORMATION”) that KidzBrands collect and use it.  Please read this document carefully to learn more about how we collect, use, share and protect PERSONAL INFORMATION.  PERSONAL INFORMATION means any information that identifies or relates to a particular individual and also includes information referred to as “personally identifiable information” (PII), “personal information” or “personal data” under applicable data privacy laws, rules, or regulations.  This PRIVACY POLICY does not apply to the practices of companies we do not own or control, or people that we do not manage.  For example, it does not apply to the use of purchaser shipping information by a merchant.  Any capitalized terms we use in this PRIVACY POLICY without defining them have the definitions given to the, in the Term of Use which govern your use of the SERVICES.

By using or accessing the SERVICES, you acknowledge that we will collect, use and share your information as described in this PRIVACY POLICY and in our USER AGREEMENT.  You have choices about whether to provide us with information and how we use that information.  You may choose not to provide us with information, but your choice(s) may prevent you from using the SERVICES or limit your use of certain features. 

We are constantly trying to improve our SERVICES, so we may need to update this PRIVACY POLICY.  KidzBrands reserves the right, at its sole discretion, to change, modify, update, add, or remove portions of this PRIVACY POLICY at any time, with our without notice to you.  Please check this PRIVACY POLICY periodically for changes.  Your continued use of the Website and Apps after the positing of any changes to the PRIVACY POLICY will signify your acceptance of those changes.   

Information We Collect

We collect Non-Personal Information (“NON-PERSONAL INFORMATION”) or Non-Personal Identifiable Information (“Non-PII”) and PERSONAL INFORMATION or PII either directly from you or from THIRD PARTY sources and our PRIVACY POLICY depend on the nature of the relationship you have with us and the requirements of applicable law.  Some of the ways that we collect information include:

You may provide information directly to us when you interact with the Website or App, make a purchase, participate in surveys or sweepstakes, request SERVICES or information, or by completing your Account Profile.

As you navigate the Website or App, certain passive information may also be collected about your visit, including through cookies and similar technologies as described below.

We endeavor to collect only that information which is relevant for the purposes of providing the SERVICES. 

NON-PERSONAL INFORMATION or NON-PII includes information that cannot be used to personally identify you.  Examples of NON-PERSONAL INFORMATION or NON-PII include, but are not limited to, anonymous usage data, IP addresses, general demographic information we may collect, referring/exit pages and URLs, platform types, cursor movement, preferences you submit and preferences that are generated based on the data you submit and number of clicks, log files, web beacons, the type of internet browser you are using, the type of computer operating system you are using, the time and date of your use of the Website or App. Age and gender, and whether you clicked on hypertext links within the Website.  We may collect NON-PERSONAL INFORMATION or NON-PII while you use the Website or App. NON-PERSONAL INFORMATION or NON-POO also includes information that is stripped of all identifiers or that has been combined with other information such that no individual can be identified.

PERSONAL INFORMATION or PII includes your name, email, birthday and mailing address which you submit to us through the registration process at our Websites or Apps, make a purchase, participate in surveys or sweepstakes, request SERVICES or information, or by completing your Account Profile.

Third-Party Content, Links, or Plug-ins

Our website and app may contain links to websites operated and maintained by third parties, over which we have no control.  Privacy policies on such linked websites may be different from our PRIVACY POLICY.  As such, we are not responsible for the privacy policies of those third-party websites or the information or content they contain.  To the extent that you access or use the Site through or on another website or app, then the privacy policy of that other website or app will apply to your access or use of that site or application.  We encourage our users to read the privacy policies of other websites before disclosing any of your information on such websites.

Our website and app may also you the ability to interact with social plugins from social media site, which may allow us and/or the social media site to receive data from or about you.  In some cases, we may know that you clicked on a social plugin, such as a Twitter Follow button, or receive other information from the social media sites.  Similarly, if you have previously provided personal information to a third-party operating a plug-in on our website and app, then such third-party may recognize you on our website and app. Your use of social network plugins is subject to each social media site’s privacy policy, which may be different from ours, so please read these policies carefully to understand their policies and your options.  As with linked sites, we have no control over the information that is collected, stored, or used by social network plugins, and are not responsible for the practices of such sites.

Rights

Depending on your residence or location you may have certain rights related to the collection and use of your PERSONAL INFORMATION/DATA.

(i) European Economic Area (EEA) Residents

If our processing of your PERSONAL DATA is covered by European data protection law, you typically have certain rights, including:

Access and Rectification – You can access and review PERSONAL DATA associated with your account at any time.  You may also issue a data subject rights request to access the PERSONAL DATA we hold about you.  You may also request rectification or correction of inaccurate and incomplete records of your personal data.

Restriction and Erasure – In certain situations, you can ask that we stop using your data, for instance, if accuracy of your PERSONAL DATA is contested.  You may also ask us to delete your PERSONAL DATA, however, we may be required to keep certain data to comply with legal obligations, such as local tax regulations.  Deactivation must be completed in order to delete an account (and the PERSONAL DATA associated with it).

Portability – In certain situations, you may ask us to transfer your PERSONAL DATA directly to you.  On your request, and where feasible, we will transfer your PERSONAL INFORMATION to another party that you select.

Objection – In certain situations, you may have a right to object to the processing of your PERSONAL DATA.  The reason(s) for an objection must relate to your particular circumstances, such as processing of your PERSONAL DATA for direct marketing purposes. 

Consent Withdrawal – Where you provided your consent to process your PERSONAL INFORMATION, you always have the right to withdraw that consent at any time.  Withdrawing consent will not affect the lawfulness of processing prior to the withdrawal.

Complaints – You have a right to raise questions or complaints with us as described below or with your local data protection authority at any time.

(ii) California Residents

If you are a California resident, you may have certain rights.  California law may permit you to request that we:

Provide you the categories of PERSONAL INFORMATION we have collected or disclosed about you in the law twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your PERSONAL INFORMATION; and the categories of THIRD-PARTIES with whom we shared PERSONAL INFORMATION.

Provide access to and/or a copy of certain information we hold about you.

Delete certain information we have about you.

You may have the right to receive information about the financial incentives that we offer to you.  You also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights.  Certain information may be exempt from such requests under applicable law.  We need certain types of information so that we can provide the SERVICES to you.  If you ask us to delete it, you may no longer be able to access or use the SERVICES.

If you would like to exercise any of your California consumer rights, please submit a request at info@littlepouch.net or visit our Website or App, where you can select Customer Support.  To do so, you will typically need to demonstrate control of the relevant account and show California residence.  You can also designate an authorized agent to make a request on your behalf.  To do so, you must provide us with written authorization or a power of attorney, signed by you, for the agent to act on your behalf.  You will still need to verify your identity directly with us.

California Shine the Light – if you are a California resident, you may ask for a list of THIRD PARTIES that have received your information for direct marketing purposes during the previous calendar year.  This list also contains the types of information shared.  We provide this list at no cost.  To make such a request, contact us at privacy@littlepouch.net.

(iii) Nevada Residents

Under Nevada law, certain Nevada consumers may opt out of the sale of PII for monetary consideration to a person for that person to license or sell such information to additional persons.  PII includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online.

We do not engage in such activity; however, if you are a Nevada resident who has purchased or leased goods or services to opt out of any potential future sales under Nevada law by emailing info@littlepouch.net.  Please note we will take reasonable steps to verify your identity and the authenticity of the request.  Once verified, we will maintain your request in the event our practices change.

Children’s Privacy

We do not knowingly collect or solicit PERSONAL INFORMATION as defined by the U.S. Children’s Online Protection Act (COPPA) from anyone under the age of 13 through this Platform.  If you are under 13, please do not attempt to register for the Services or send any PERSONAL INFORMATION about yourself to us.  We encourage parent(s) and legal guardian(s) to monitor their children’s Internet usage and to help enforce our PRIVACY POLICY by instructing their children never to provide PERSONAL INFORMATION without their permission.  Parent(s) and guardian(s) should be aware that there are parental control tools available online that you can use to prevent your children from submitting information online without parental permission or from accessing material that is harmful to minors. If we learn that we have collected PERSONAL INFORMATION from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you have reason to believe that a child under the age of 13 has provided PERSONAL INFORMATION to us, please contact us at privacy@littlepouch.net, and we will endeavor to delete that information from our database.  Little Pouch provides CHILD ACCOUNTS as a simple way for parent(s) and guardian(s) manage an account on behalf of a child to include pouch lists and preferences in their Little Pouch group.

For residents of the EU where processing of personal data is based on consent, we will not knowingly engage in that processing for users under the age of consent established by applicable member or data protection law.  If we learn that we are engaged in that processing with such users, we will halt such processing and will take reasonable measures to promptly remove applicable information from our records.

If you are 13 or older, but have not reached your country’s age of majority (i.e. able to enter an agreement), you should use the SERVICES with permission from your parent(s) or guardian(s).
